Is Forex Trading Legal in India?
Yes, but, within certain boundaries. For Indian residents, they can trade currency futures and options on currency pairs approved by the RBI on the NSE, BSE or MSE, through SEBI registered brokers.
What FEMA and RBI Allow
Retail forex trading is allowed only for exchange-traded currency derivatives under Foreign Exchange Management Act (FEMA), 1999. Residents are not allowed to use a spot forex and CFD platform.
Which Currency Pairs Are Permitted
The trader can trade USD/INR, EUR/INR, GBP/INR and JPY/INR. SEBI has also introduced a couple of cross currency pairs – EUR/USD, GBP/USD and USD/JPY – on regulated exchanges.
Why Offshore Brokers Are Risky
Offshore brokers tend to promote high levers but it is considered a violation of FEMA by the citizens to deal with non-INR pairs. There is no SEBI compensation scheme or formal dispute resolution mechanism under the Indian securities law either, and clone-broker scams are still prevalent.
